Terms and conditions
These terms apply to consumers who request or book a service from yeply. If you request a service and we travel to you, you pay for the work that is needed. Below is exactly what you can expect from us, and we from you.
Definitions
1.1yeply: Yeply Netherlands B.V., Kaasmakerstraat 44, 3194 DJ Hoogvliet Rotterdam, Chamber of Commerce 84039841, VAT NL863072823B01, hallo@yeply.nl.
1.2Consumer: a natural person not acting in the course of a profession or business who enters into an agreement with yeply.
1.3Service: maintenance, repair, inspection or fitting on a bicycle, e-bike, speed pedelec or other two-wheeled vehicle accepted by yeply for the relevant service category.
1.4Service location: the address given by the consumer where the service is performed, or a yeply workshop.
1.5Person present: the person present at the service location at the agreed time who offers the vehicle.
1.6Additional work: work or parts not included in the package the consumer booked.
1.7Vehicle category: the classification published by yeply on its website that determines the price and duration of the service.
1.8Working day: Monday to Friday, excluding public holidays generally recognised in the Netherlands.
Applicability
2.1These terms apply to every offer by yeply to a consumer and to every agreement concluded between yeply and a consumer.
2.2yeply makes these terms available electronically before or at the conclusion of the agreement, in a way that allows the consumer to store them and consult them later. On request yeply sends them free of charge.
2.3Deviations apply only if yeply has confirmed them in writing or electronically.
2.4If a provision is void or annulled, the remaining provisions stay in force and the parties will agree a replacement that stays as close as possible to the intention of the original.
2.5These terms do not affect the rights the consumer has under the law.
The offer
3.1yeply shows the price of the service before the consumer confirms the booking. Consumer prices are in euros and include VAT.
3.2The price of a booked package covers labour, travel time within the service area and the work listed in the package. Parts and additional work are not included unless the package expressly says so.
3.3Price and duration depend on the vehicle category. If the vehicle offered belongs to a higher category than booked, yeply may adjust the price or propose a new appointment, in either case after consulting the consumer.
3.4An obvious error or mistake in an offer does not bind yeply.
Conclusion of the agreement
4.1The agreement is concluded when yeply has confirmed the request or booking electronically.
4.2The confirmation states the booked service, the price, the time slot, the service location and the version number of these terms, and includes these terms as a file the consumer can keep.
4.3Where a request is made by telephone, email or a messaging service, yeply sends the consumer a single link through which the consumer sees the price, accepts these terms and pays.
Payment
5.1The price is paid in the manner belonging to the channel through which the service was requested:
a. for a booking through the online booking platform: in full at the moment of booking;
b. for a service request, or a request made by telephone or a messaging service: in full, through a payment request sent by yeply;
c. where payment under (b) has not been received before the slot: by the consumer at the service location, on receipt of the work order;
d. where payment at the service location does not follow: yeply charges the amount due by invoice.
5.2Whatever the channel, a consumer who has requested a service and at whose request yeply has travelled to the service location owes the price of the booked service and of any approved additional work.
5.3Additional work and parts are paid before yeply begins that work, unless the parties agree otherwise electronically.
5.4The work order states the work performed, the parts used and the amount due. The consumer or the person present confirms receipt of the work order at the service location.
5.5A payment counts as received when the amount has been credited to yeply’s account.
5.6Where an invoice is issued, the payment term is fourteen days. If the consumer does not pay within that term, yeply sends a demand granting a further period of fourteen days, counted from the day after the demand is received, stating the amount of extrajudicial collection costs that will become due if payment does not follow. Those costs are calculated in accordance with the statutory scheme.
5.7Refunds are made using the same payment method, within fourteen days of the entitlement being established.
Presence and authority at the service location
6.1The consumer ensures that the vehicle is available and accessible at the agreed time and that a person of at least eighteen years of age is present, unless another way of presenting the vehicle has been agreed with yeply electronically.
6.2As towards yeply, the person present is deemed authorised to give instructions, to accept the service and to approve additional work up to the amount the consumer specified when booking. The consumer is bound by those acts.
6.3If no authorised person is present, the vehicle is not accessible, or a vehicle other than the one booked is offered, article 10 applies.
6.4The consumer provides a telephone number on which they are reachable during the agreed slot.
6.5The person present is likewise deemed authorised to receive the work order and to pay on the consumer’s behalf.
Performance of the service
7.1yeply performs the service with proper workmanship and using suitable parts.
7.2The stated slot is an indication. yeply informs the consumer as soon as possible of any material delay and then offers a new slot or a refund.
7.3yeply may have the work performed by a different mechanic.
7.4The consumer provides a working space in which work can be carried out safely.
Additional work and parts
8.1If additional work or parts prove necessary during the service, yeply informs the consumer or the person present of the nature, the price and the extra time before that work starts.
8.2Additional work is carried out only after express approval, which yeply records electronically, and after payment under article 5.3.
8.3If additional work is not approved, yeply completes only the booked service. yeply may determine that the vehicle is not safe to use and report that in writing or electronically.
8.4Replaced parts are disposed of by yeply unless the consumer asks to keep them when the vehicle is handed back.
Vehicle categories and surcharges
9.1yeply publishes the vehicle categories, their surcharges and the time reserved for them on its website.
9.2For speed pedelecs and moped-class vehicles, the consumer must hold the insurance required by law and, where applicable, registration. yeply may refuse the service if that is not the case.
9.3yeply may refuse the service for vehicles modified such that safe repair is not possible, and for vehicles with a damaged battery or damaged electrical system.
Changes, cancellation and a missed appointment
10.1Up to forty-eight hours, counted in working days, before the slot begins, the consumer may move or cancel the appointment free of charge, with a full refund. That period amounts to two working days before the slot, at the same time of day. yeply states the exact final date and time in the confirmation.
10.2Where the consumer cancels within that period, or the appointment is not kept, yeply retains the full price of the booked service, including the call-out fee.
10.3Within that period the consumer may move the appointment once, free of charge, to a slot within thirty days, provided they say so before the slot begins.
10.4An appointment is not kept where, fifteen minutes after the slot begins, no authorised person is present, the vehicle is not accessible, or a vehicle other than the one booked is offered.
10.5The amounts in this article cover travel time, the reserved slot and the mechanic’s time.
10.6Where yeply has requested payment in advance and it has not been received twenty-four hours before the slot begins, yeply may cancel the appointment. yeply warns the consumer no later than forty-eight hours before the slot. If yeply lets the appointment proceed, the consumer pays at the service location under article 5.1(c).
10.7yeply may move or cancel an appointment where weather prevents safe work, in case of illness, or in case of force majeure. The consumer then chooses between a new slot and a full refund.
10.8This article does not affect the right of withdrawal in article 11.
Right of withdrawal
11.1In the case of a distance contract, the consumer may withdraw within fourteen days of its conclusion without giving reasons.
11.2If the consumer wants the service performed within those fourteen days, they expressly request yeply when booking to begin, and declare that they lose the right of withdrawal once yeply has fully performed. yeply records both declarations with the booking.
11.3If the consumer withdraws while the service has been partly performed, they owe an amount proportionate to the part already performed.
11.4The right of withdrawal does not apply where the consumer specifically requested yeply to visit in order to carry out urgent repairs or urgent maintenance. It does continue to apply to additional services the consumer did not expressly request and to goods supplied that were not necessary for that repair or maintenance.
11.5The consumer withdraws by an unambiguous statement to hallo@yeply.nl or using the model form yeply provides. yeply refunds what is due within fourteen days.
Conformity and warranty on the service
12.1The consumer’s statutory rights in the event of a defect remain fully in force.
12.2In addition, yeply gives three months’ warranty on the labour performed and on parts supplied by yeply, counted from the date of the service, unless the manufacturer’s warranty on a part runs longer.
12.3The warranty in article 12.2 does not apply to normal wear, to damage caused by a fall, misuse or third-party intervention, to parts supplied by the consumer, or to defects reported after the warranty period has expired.
12.4The consumer reports a defect within a reasonable time of discovering it. yeply repairs or replaces free of charge. If that does not succeed within a reasonable period, the consumer has the remedies the law gives them.
Liability
13.1yeply is liable for damage attributable to it under the law.
13.2Liability is neither excluded nor limited for intent or conscious recklessness on the part of yeply or its managers, for death or personal injury, or for any other liability that cannot be limited by law.
13.3Otherwise, yeply’s liability is limited to the amount its liability insurer pays out in the case concerned, increased by the deductible.
13.4yeply is not liable for the consequences of additional work it advised and the consumer did not approve, provided yeply recorded that advice electronically.
13.5The consumer is liable for damage to yeply’s tools or property resulting from unsafe conditions at the service location or from incorrect information about the vehicle.
Safety, and refusing or stopping work
14.1yeply may refuse or stop the service where safe work is not possible, where the vehicle presents a danger, or where its mechanic is threatened or intimidated.
14.2yeply reports the reason in writing or electronically. Where the cause is attributable to the consumer, yeply retains the part of the price covering travel time and the mechanic’s time already spent, and refunds the remainder.
14.3yeply may refuse to transport or handle a damaged lithium battery.
Complaints and disputes
15.1The consumer may report a complaint within a reasonable time to hallo@yeply.nl. yeply responds substantively within fourteen days or states when it will.
15.2Dutch law applies to the agreement.
15.3Disputes are brought before the competent court, without prejudice to the consumer’s right to bring the dispute before the court designated as competent by law. yeply is not affiliated with a consumer disputes body.
Personal data, amendments and force majeure
16.1yeply processes personal data in accordance with the privacy policy and applicable privacy law.
16.2yeply may amend these terms. The version the consumer accepted when booking applies to that agreement. Every version carries a number and an effective date and remains retrievable.
16.3In case of force majeure, yeply’s obligations are suspended. If force majeure lasts longer than thirty days, either party may terminate, and yeply refunds the part not performed.
16.4These terms were drawn up in Dutch. In the event of a discrepancy between the Dutch text and this translation, the Dutch text prevails.
